FBI raid turns up more stolen docs

Bidens home was raided and more stolen documents located.

Question is how many Chinese and Russian agents had access to these docs.

Unlike the failed former president, Biden’s White House lawyer
Bob Bauer said, “The President and his team are working swiftly
to ensure DOJ and the Special Counsel have what they need to
conduct a thorough review.”

Recall how obstructive Captain Bonespurs was in giving up the
thousands of classified documents—which he initially denied
possessing—that he misappropriated.  Plus it took court-ordered
subpoenas to allow the FBI to raid Mar-a-Lago.

And of course Captain Bonespurs is now under criminal investigation
by a special counsel for taking classified records and other government
documents from the White House when he left office. He's also being
eyed for possible obstruction of justice by stonewalling efforts by
government officials to recover those documents.

It's apples and oranges.

Trump committed a crime:

Federal law (18 U.S. Code § 1924) states that anyone who “(1) knowingly removes such documents or materials without authority and (2) with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both.”

Knowingly removed documents or materials without authority?  Check.  Stole them after he lost the election.

With the intent to retain such documents or materials at an unauthorized location?  Check.  Said they were his and had no intention of giving them back.

Moreover, he has confessed to doing this several times.

Open-and-shut case: he committed the crime.  We just need to see if he'll be charged.

But with Biden:

Knowingly removed documents or materials without authority?  No.  He was a sitting, elected Vice President - he had full authority.

With the intent to retain such documents or materials at an unauthorized location?  No.  As soon as they were discovered he arranged for them to be returned, plus he collaborated with the FBI & DOJ in order to carry out further searches designed to locate and return any other documents that were still in his possession.

Apples and oranges, people.  You're clutching at straws.

He removed them when he was VP.

He removed them when he was an elected representative.

There is no crime there.

Plus, in order for it to be a crime he would have to have also had intent to retain them - he didn't.

He hasn't committed a crime, whereas Trump has.

The story is real stupid - At that time he didn't have access to classified documents as he said. The rest just confirms that he didn't know there were classified documents in the office.

Hardly a gotcha when it is only confirming Biden's current position as being correct and consistent with what was said in the previous interview..

Exactly.

But at the time they were removed, he did.

However, for the sake of the argument, let's just say that he removed them when he did not have authorisation - that's still not a crime.

There are two parts to the crime (the numbers in brackets were put in by me):

Federal law (18 U.S. Code § 1924) states that anyone who “(1) knowingly removes such documents or materials without authority and (2) with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both.”

(1) is not a crime on its own - it must be accompanied by (2).

That's why the word "and" is inserted into the legalisation.

It's not one or the other - it's both, and Biden clearly has no intention of retaining the documents.
