not have authorisation - that's still not a crime.
There are two parts to the relative legislation (the numbers in brackets were put there by me):
Federal law (18 U.S. Code § 1924) states that anyone who “(1) knowingly removes such documents or materials without authority and (2) with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than five years, or both.”(1) is not a crime on its own - it
must be accompanied by (2).
That's why the word "
and" is inserted into the legalisation.
It's not one or the other - it's
both, and Biden clearly has no intention of retaining the documents.
Thus, no crime.
