I appreciate your effort, but you didn't read it properly.
First, Biden had authority to remove the documents and secondly, he had no intention to retain them (he gave them back).
Pay close attention to the word "and".
Even if, for the sake of the argument, he
did intend to retain them in an authorised location it's still not breaking that particular law.
Why not? He had authority to remove them.
Again, I urge you to pay particular attention to the word "and", highlighted.
