Burger King faces legal claim over size of Whopper


Burger King must face a lawsuit that alleges it makes its Whopper burger appear larger on its menus than it is in reality, a US judge has ruled.

The lawsuit accuses the fast food giant of misleading customers by showing the burger with a meatier patty and ingredients that "overflow over the bun".

"The plaintiffs' claims are false," Burger King told the BBC.

Rivals McDonald's and Wendy's are facing a similar lawsuit in the US.

The class action lawsuit against Burger King alleged that the Whopper was made to look 35% larger, with more than double the amount of meat compared to what was actually served to customers.

Burger King had earlier argued that it was not required to deliver burgers that look "exactly like the picture".

In the ruling, US District Judge Roy Altman said it should be left to jurors to "tell us what reasonable people think".

However, he dismissed claims that Burger King misled customers with its television and online advertisements.

"The flame-grilled beef patties portrayed in our advertising are the same patties used in the millions of Whopper sandwiches we serve to guests nationwide," a Burger King spokesperson said in a statement after the ruling.

Lawyer Anthony Russo, who represents the plaintiffs, did not immediately respond to a BBC request for comment.

All the advertising images lack anything to scale off, so I'm not sure how it is even possible to misrepresent the size. The ratio of the patty size to the bun is definitely different though.

The 1st pic has the meat as thick as the bottom bun.
The 2nd one looks thicker. You're ahead by 2mm making a profit on the deal.

I don't really care what it looks like. I just never end up feeling as satisfied as I expect.



OK - it's better to go to the local fish and chip shop -
there's one only 4 minutes drive from my place that makes fantastic
hamburgers with the lot.
They even toast the buns too!

A couple days ago…. At H.Jacks I thought I would try their crunchy chicken burger out.
I walked into the reception area and stood at the counter waiting to order.
It was about 3.30-4pm
I noted another person before me was ordering on the online screen.
So she stood waiting after.
And we waited and waited….
I noticed there seemed a staff shortage and they were attending to drive through orders only.
It got ridiculous!
The young female standing near me… we looked at each other with a not so impressed concern.
Spoke a few words and I said it looks like they’re understaffed too.

She had enough and started saying as she bent over the counter “excuse me, where’s the manager?!”
And he came and she didn’t mince words. Saying letting an elder person like myself left standing for ages waiting to order etc
I was feeling really “unhungry” after all this!   Grin

She walked out in disgust.
I stood there as another person came in and I asked… “Do drive throughs get served first and more quickly?” He winked and said “You got it, it’s best to, especially at peak times.

It’s too difficult for me to do drive through as I don’t hear the person taking order on speaker. And I want to ask for my seniors free drink too.
Never mind, more personal service is out of fashion.

I recall with R.Rooster when they were understaffed they locked the doors with an apology and to go via drive through.
I will write to H.Jacks to think in terms of doing same.
I am not a confrontational person on the spot… I take it all in and assess, and try to analyse all aspects.
So I’m certain writing with my identity and contact  rather than anonymously, would get more serious thought to it.
Honestly, I’m too frightened to walk into fast food outlets now!
From plodding along thinking of a crispy chicken burger to landing in a big confrontational situation  Undecided

It's too dangerous to sit down at those places.
They have fights all the time.
Always use the drive thru.
