EXCLUSIVE

An Afghan refugee who repeatedly approached boys for sex after being freed from immigration detention did not think he had done anything wrong or committed a criminal offence.

The man, given the pseudonym FYBR, was jailed for his crimes against children then returned to a detention centre and could now be back on the streets.

FYBR was on a list of serious offenders prepared by the Department of Home Affairs ahead of the High Court's ruling that indefinite immigration detention was unlawful.

The court's decision has seen at least 111 detainees including murderers, rapists and paedophiles let out into the community and FYBR is likely among them.

FYBR served more than nine months in prison and was then transferred to immigration detention, where he spent the next seven years. The photo shows Villawood detention center in Sydney’s west

FYBR applied for a safe haven visa as he faced persecution due to
his Hazara ethnicity and Shia Muslim religion,

but was denied because he did not meet the character test.

The Administrative Appeals Tribunal again rejected FYBR when it attempted to overturn that decision.

“FYBR knows that what he did in Australia was unacceptable because of the consequences of his actions for him, but he does not understand why his actions were wrong,” it said.

‘He seemed to think his behavior was acceptable because he didn’t touch his victims.

‘The tribunal concludes from his evidence that at the material time he believed that the freedom available in Australia, compared to the restrictions on his conduct in Pakistan, enabled him to solicit minors to satisfy his sexual desires.’

The tribunal rejected FYBR’s claim that he was now aware of Australian law and spent every night reading a code of conduct provided to him while in detention.

The federal government will introduce
a $255 million boost to law enforcement

in the wake of a High Court decision on immigration detention earlier this month.
Key points:

    The funding will be split between Australian Border Force, Australian Federal Police and other agencies
    The government said it was focused on ensuring the safety of the community within the limits of the law
    Human rights lawyers and the Greens have raised concerns about legislation introduced after the High Court ruling

The High Court decision found it unconstitutional to detain people indefinitely, resulting in the release of more than 93 non-citizens, some of whom are convicted criminals.

The funding will include $150 million for the ABF to provide additional staff in "compliance, investigations, removal and surveillance functions", and $88 million for the AFP that will include funding to investigate breaches of visa conditions.

Seven murderers, 37 sex offenders and 72 violent criminals were released from immigration detention by the Albanese government following last year’s NZYQ High Court ruling.

Documents tabled in the Senate on Monday morning reveal the 149 detainees released also included 16 domestic violence offenders, 13 drug traffickers, and five people convicted of people smuggling or other crimes of international significance.

Just five of those released had committed low-level crimes, or were not criminal offenders.

They were ALL convicted criminals, idiotic cockwomble. After they served their sentences they were locked up in immigration detention because they were in Australia ILLEGALLY, ie without a valid visa.
