ICJ orders Israel to take action to address famine in Gaza

In a new set of provisional measures, the World Court ordered Israel to open more land crossings to allow aid into Gaza.

28 Mar 2024

Judges at the International Court of Justice have unanimously ordered Israel to take all the necessary and effective action to ensure basic food supplies arrive without delay to the Palestinian population in Gaza.

The ICJ judges said in an order on Thursday that Palestinians in Gaza face worsening conditions of life and famine and starvation are spreading.

“The court observes that Palestinians in Gaza are no longer facing only a risk of famine … but that famine is setting in,” the judges said. “At least 31 people, including 27 children, having already died of malnutrition and dehydration according to the United Nations Office for the Coordination of Humanitarian Affairs,” they said.

In its legally binding order, the court told Israel to take “all necessary and effective measures to ensure, without delay, in full co-operation with the United Nations, the unhindered provision at scale by all concerned of urgently needed basic services and humanitarian assistance” including food, water, fuel and medical supplies.

As a South African spokeswoman said last month on Israel using starvation as a weapon of war, "If I deny you food, if I deny you water, if I deny you medical aid, then my intention is to kill you."

Hamas is the government in Gaza, why don't they provide for their people?? What's what they were elected to do by the Gazan, weren't they? Is Hamas too busy with something else other than looking after the people who elected them??

They are too busy seeking revenge for the Muslims who  were ousted from the Israeli allotment of Palestine, in 1947.

How about establising the two state solution?

I expect (moderate) Fatah would attract majority support from Palestinians after 70 years of conflict, if the US stopped blocking UN res 242.

Opposing one atrocity The deliberate murder of over 30,000  innocent people does not mean supporting Hamas for their atrocities.

It is perfectly reasonable to oppose all of these atrocities.

‘Unnaturally Afraid’ – Netanyahu Worried ICC Could Issue Arrest Warrants

In recent days, according to the report, Netanyahu has reached out to various international leaders and officials, including US President Joe Biden, in an effort to prevent the issuance of such a warrant.

Israeli Prime Minister Benjamin Netanyahu expressed deep concern over the possibility of the International Criminal Court (ICC) issuing an arrest warrant for him and other high-ranking officials, according to Israeli media.

This comes amid Israeli media reports of the potential issuance of arrest warrants by the ICC against Netanyahu and other Israeli political and military leaders – such as Defense Minister Yoav Gallant and Chief of Staff Herzl Halevi – for alleged violations of international law in the ongoing assault of the Gaza Strip.

The Israeli newspaper Maariv cited unnamed sources as saying that Netanyahu is “unnaturally afraid and worried” about the prospect of facing an ICC arrest warrant in The Hague.

In recent days, according to the report, Netanyahu has reached out to various international leaders and officials, including US President Joe Biden, in an effort to prevent the issuance of such a warrant.

‘Under My Leadership’

On Friday, Netanyahu said any decisions made by the ICC will not affect Israel’s actions, but would however “set a dangerous precedent.”

“Under my leadership, Israel will never accept any attempt by the ICC to undermine its inherent right of self-defense,” he wrote on X.

‘Under My Leadership’ – Netanyahu Says ICC Decisions Will Not Affect Israel’s Actions

“Israel will continue to wage to victory our just war against genocidal terrorists and we will never stop defending ourselves,” said Netanyahu.

According to another report by Maariv, senior Israeli officials expressed concern about the tweet in which Netanyahu criticized the ICC.

“Netanyahu’s tweet itself is a mistake,” the sources were reported as saying.

“Any statement could complicate the complex situation even more, and there is no reason to convey to the court a message that could be interpreted as threatening,” the officials reportedly added.

Netanyahu’s Lifeline

The Israeli newspaper The Jerusalem Post quoted an unnamed Israeli diplomatic source as saying that the ICC “could not act against Prime Minister Benjamin Netanyahu and top IDF brass without overt or tactic support from the United States”.

“Where is Biden? Why is he quiet while Israel will potentially be thrown under the bus?” the source reportedly said.

Israel Fears ICC Arrest Warrants over Gaza War Crimes – What We Know So Far

A Wall Street Journal editorial urged on Saturday the US and the UK to intervene.

“Mr. Khan’s candidacy was championed by his native Britain and supported by the U.S., so both countries may have influence if they warn Mr. Khan of what will happen if he proceeds,” the editorial said.

“If they don’t, President Biden and Prime Minister Rishi Sunak risk finding Americans and Britons next under the gun” the editorial continued.

Gaza Genocide

Currently on trial before the International Court of Justice for genocide against Palestinians, Israel has been waging a devastating war on Gaza since October 7.

According to Gaza’s Ministry of Health, 34,454 Palestinians have been killed, and 77,575 wounded in Israel’s ongoing genocide in Gaza starting on October 7.

Moreover, at least 7,000 people are unaccounted for, presumed dead under the rubble of their homes throughout the Strip.

Palestinian and international organizations say that the majority of those killed and wounded are women and children.

The Israeli war has resulted in an acute famine, mostly in northern Gaza, resulting in the death of many Palestinians, mostly children.

The Israeli aggression has also resulted in the forceful displacement of nearly two million people from all over the Gaza Strip, with the vast majority of the displaced forced into the densely crowded southern city of Rafah near the border with Egypt – in what has become Palestine’s largest mass exodus since the 1948 Nakba.

Happening live now at The Hague:

ICJ hears South Africa request over Israeli assault on Gaza’s Rafah

The International Court of Justice (ICJ) is holding hearings to discuss a request by South Africa seeking additional emergency measures over Israel’s offensive on Rafah, a city in southern Gaza where more than one million displaced Palestinians sought shelter from Israel’s war.

South African Professor Max du Plessis says Attacks on Rafah show ‘genocidal intent’:

Professor Max du Plessis says the fact that Israel pushed more than one million Palestinians into Rafah and then carried out a “full-scale bombardment” of the province, all while sealing it off from aid and exposing it to famine, he said, is evidence of this intent.

This shows that Israel’s use of evacuation zones are “purely performative”, only further “endangering” Palestinian life, du Plessis added.

South African lawyer Adila Hassim lists five features of what she describes as a “genocidal campaign by Israel”:

Israel has continued to kill Palestinians in Gaza, including women and children, at an alarming rate.

As a result of Israel’s onslaught, Palestinians in Gaza are facing what the undersecretary-general of the UN has described as the worst humanitarian crisis he has seen in more than 50 years.

Israel’s systematic targeting and bombardment of hospitals and medical facilities and its throttling of humanitarian aid have pushed Gaza’s medical system to collapse.

Israel’s direct attack and siege of Gaza’s biggest hospitals has led to the uncovering of mass graves evidencing Israeli massacres of Palestinians seeking shelter and medical treatment.

Most recently, Israel has intensified its attacks in the north while pressing on with its Rafah offensive, leaving displaced Palestinians with nowhere safe to go.

Adila Hassim has provided more details on what she says are features of “genocidal conduct” in Gaza.

1. Killings: Since South Africa first appeared before the ICJ in January, she says, at least 11,500 Palestinians have been “directly killed by Israel”, the majority of them women and children. On average, two mothers and four children are killed every hour. “This onslaught has occurred despite the binding orders of this court”, she says.

2. Humanitarian catastrophe: Israel has created a humanitarian crisis in a “coordinated” way, she says, stopping food and aid from entering the enclave, while stopping the chronically sick and injured from getting out. Conditions in Gaza look set to worsen with Israel’s ongoing attacks on the north, middle and south”.

3. Crippling of Gaza’s medical system: Israel’s offensive on Rafah has further crippled Gaza’s health system, forcing most health facilities to shut down.
