You can tell IDF from non-IDF. They do not hide behind civilians. Israel is a civilised country. It is livelier, more interesting, infinitely freer and humane and, well, CIVILISED than any of the Mohammedan countries from the Atlantic to Indonesia.

There is NO WAY that Israel will compromise with Hamas after 7 October. Nor should it. The presence of Hamas has become unacceptable after that hideous pogrom.

If Palestinians want to throw their civilians into the pit of war on Hamas, let them.  It is a cowardly and despicable blackmailing tactic that you, totally predictably, approve of.

days of the Gillard government. One can only imagine the moniker given to the two MPs who have self-immolated amid the first-term
governments of Anthony Albanese and Chris Minns.

It should not be as kind.

The first is Fatima Payman, a first-term senator from WA who has
caused untold damage in what was supposed to be the most important
week for the Albanese government this calendar year.

In case Senator Payman failed to notice, this was budget week. The handing down of the final budget before the next election, upon which the
government’s survival depends.

Yet the very next day it was the wellbeing of her conscience that Senator Payman was most worried about, and needed to express as
much to a group of journalists at Parliament House.

“My conscience has been uneasy for far too long and I must call this out for what it is. This is a genocide and we need to stop pretending
otherwise.”

No, she wasn’t quoting an advance copy of Peter Dutton’s budget reply, she was talking about an ongoing millennia-old conflict on the opposite
side of the planet.

Speaking of genocide, Payman also ended her speech with the infamous catch cry “From the river to the sea, Palestine will be free”, which the Prime Minister has rightly condemned as a call for the elimination of the state of Israel.

Thus less than 24 hours after a budget delivering tax cuts and power bill relief for every Australian – a message Labor is desperate to dominate –
the Albanese government has been instantly derailed by one of its own for the sake of self-indulgent virtue signalling about a war on the other side of the globe.

Maybe Payman is on Dutton’s payroll. Or maybe she is just doing his work for free.

Either way it’s an appalling act from a first-term Labor senator. Ironically
she won’t have to worry about re-election next year but she has shafted her leader’s chances.

And so Anthony Albanese, who already has to deal with pro-Palestinian Trots on campus and outside his office, now has to deal with them in his caucus.

To the PM’s credit he quickly and firmly condemned Payman’s comments as “inappropriate”, and Labor senators then voted with the Coalition to
condemn the “River to the sea” slogan but the damage was done.

And so the question begs: Why are Labor MPs whose electorates are some 12,000km from Israel so desperate to blow up their party on this issue?

Payman is not even from the Holy Lands – she was born in Afghanistan.

Perhaps she is just determined to speak out against wars in general – although I am unfamiliar with any of her outrage against the Russian invasion of Ukraine.

But soft! What light from yonder window breaks?

Enter NSW Labor MP – and possible part-time French rapper –Anthony D’Adam.

Not to be outdone, D’Adam, on the same day no less, managed to disgrace himself in the state’s upper house by likening NSW police to “an occupying army using force to control a civilian population” and accusing
the Commissioner of being a liar
.

“The approach of the Public Order and Riot Squad at many Palestine protests makes a liar of the Commissioner,” he said.

Premier Chris Minns, the patron saint of Sensible Labor, wasted little time in sacking the MP from his parliamentary secretary roles. D’Adam is now
on D’back bench.


Yet it was in a statement following his sacking that D’Adam truly revealed the insufferably smug self-indulgence that drives these narcissistic
crusaders.


“I understand the position that the Premier has taken and hold no malice towards him,” he said.

Sorry? Come again?

You’ve undermined the Premier and the Police Minister, pood on a government already under siege for its handling of endless Palestine protests and once again blown up the Labor Party on this tinderbox issue but it’s all OK because you forgive
them.

It is difficult to accurately chart how far one would have to be inside one’s lower intestine to even think such a thing let alone put it in a statement but there you go.

One of these wonderful men, a 43 year old "Majid Jamshidi Doukoshkan" was arrested 3 times this year, because of racism (and drug smuggling, but mostly because of racism). And on all 3 occasions, left wing judges gave him bail, to combat racism - most recently just a few weeks ago

Then on April 16, old Mate Majid broke into a 73 year old grandmother's house, bashed, and robbed her.

We should thank Mehreen and the Greens for the part they played in releasing criminals from immigration detention.





When law students are asked to cite examples of legislative ineptitude, they now have two perfect case studies.

After last year’s High Court ruling in the case known as NZYQ, the government was caught flat footed and released people from immigration detention with inadequate oversight.

It paid a terrible price for that lack of preparation. But that was just the start.

Once it had the benefit of the High Court’s reasoning in NZYQ, it would have made sense to draft a response that took account of the court’s ruling so it did not meet the same fate.

After all, when it comes to questions like the separation of powers, the court has the final say, not the government.

It is therefore astounding that a key part of the government’s legislative response to that decision – curfews and the wearing of ankle bracelets – has now been struck down for exactly the same reason.

It’s as if the parliamentary draftsmen had been instructed to ignore the risk of legislative invalidity and prepare new rules that looked so tough they would silence the government’s critics.

The latest ruling, in a case known as YBFZ, should not be seen as an example of activist judges siding with foreigners who have no business being here.

Both rulings, NZYQ and YBFZ, are examples of the court striking down improper breaches of the separation of powers by governments.

These decisions do not mean the judges will always be opposed to curfews and ankle bracelets for foreign criminals. It simply means that laws imposing punitive measures should leave the judiciary as the decision-maker.

Instead, the government’s rules on curfews and ankle bracelets left the minister for immigration as the sole decision-maker. This is at odds with the community safety supervision order regime in the Commonwealth Criminal Code.

The leading judgment in the latest case makes the point that these supervision orders can be made by state and territory Supreme Courts on application by the minister for immigration.

In retrospect, that is the approach that should have been applied to curfews and ankle bracelets.

Instead of imposing these measures only on those detainees who are proven in court to be dangers to the community, the government seems to have legislated in a state of panic.

It accepted demands from the opposition and imposed these requirements on all former detainees unless the minister is persuaded to the contrary.

The government seems to have known it was on dangerous ground. This might explain why it paid legal costs and surrendered to several former detainees early this year to prevent their legal challenges from reaching the High Court.

The result began to resemble arbitrary rule: some former detainees who had been released into the community wearing ankle bracelets were relieved of that obligation while others were not.

The decision striking down the rules on curfews and ankle bracelets would have come as no surprise to anyone who was aware of the critique of this regime by constitutional lawyer Anne Twomey.

Because ankle bracelets were the default position, she warned in March that this suggested the purpose was punitive rather than a protective measure based on risk.

“And as we all know, a punitive purpose leads to constitutional invalidity,” she said on her YouTube channel, Constitutional Clarion.

The leading judgment put it this way: “The impugned conditions are a form of extrajudicial collective punishment based on membership of the class.”

This was a bad law, enacted in panic, with insufficient regard to the separation of powers.

So you were impartial because it didn't involve the Labor party, just the Greens and One Nation? We know how the ALP feels about the Greens these days, and the ALP's hate towards O.N. is a given

Faruqi should have kept her mouth shut about the Queen, because now, by extension, she feels the same way about King Charles, who presides over the very seat in Parliament that she sits her fat ass on. Charles is a very patient and forgiving King allowing her to get away with saying what she said about his long reigning mother 

Pauline on the other hand should have chosen her words more carefully and not attacked the individual, but discontented immigrants in general

Why is it wacist to tell someone from [country X] to piss off back to [country X] if they are not happy in Australia?
