President-elect Donald Trump will be sentenced on 34 counts of falsifying business records ahead of his swearing-in as president on Jan. 20, a judge ruled Friday. New York Supreme Court Justice Juan Merchan wrote that he plans to order an “unconditional discharge,” a designation in New York criminal courts for a non-jail and non-probation sentence that carries no other obligations.......

Strange. Here's what the Guardian has to say on the matter.

Quote:
Judge Juan Merchan, who presided over Trump’s trial in New York, denied the president-elect’s motion to dismiss the case due to his election victory in November. He said Trump is expected to appear for sentencing either in-person or virtually.

But I'm curious. I believe your previous take on doing crime involved doing time. What does your much beloved Constitution have to say about sentencing criminals for felonies?

Does it stipulate anything about unconditional dismissals?

Cheers.

Nope, & being the sentencing on the charges rests with New York State, one would conclude the ability to 'unconditionally dismiss' is their prerogative as well.

This, you see, is where your cult leads you, old boy. You've learned you can deny reality altogether. The response is for everybody to gather round you, all erstwhile and sincere, spelling out the facts and helping you to see the light. You love all that.

It's a form of shit and run, your old favourite. Take a shit on someone's doorstep, knock and run off, having a right old giggle as you go. They're left at the door:

Hello? I'm sure I heard something. Who is it? Oh no, I've stepped in it. Those kids! I'll get you!

But we know, old boy, and we know you know too. You can just repeat the lie. What are they going to do? They're standing there with your shit all over their shoe - what are they going to do?

This case is so obviously politically motivated, and even America’s corrupt media are at a loss to defend this: “An Associated Press analysis of nearly 70 years of similar cases showed Trump’s case stands apart: It’s the only big business found that was threatened with a shutdown without a showing of obvious victims and major losses.”

Sorry? Their prerogative?

You said Justice Juan Merchan wrote that he plans to order an unconditional dismissal. Justice Juan Merchan just wrote the exact opposite.

Justice Juan Merchan just ordered your DL to attend court, sit there quietly as he goes through the facts of his crimes, reads out the victim impact statements, goes over the forensic psych report and offender profile, outlines the typical penalties for such crimes and previous sentences, then puts it all into context. He'll explain how your DL filed fraudulent business statements, lied during his depositions, engaged in witness intimidation, lied to the media about court officials, watched on as their lives were threatened by his supporters including bomb threats to his own home. He'll show how your DL got his lawyer to take the rap and let him do three years in jail for his very own crimes, then ordered his former lawyer to be illegally detained in isolation, ruled to be the worst case of government retaliation justice ever seen during the ruling judge's 21 year career. He'll show how your DL did all this to deceive and defraud American voters, of which you are one.

So no, Panther, your DL has received no unconditional dismissal and faces sentencing on Jan 10. But I'm curious. Given your professed love of truth and justice, why would you pretend otherwise?

I do hope you haven't joined the poor old boy in his game of shit and run. You're our board's resident constitutional scholar. If you'd get muddled up about something as important as this - the criminal sentencing of your future POTUS - where can we turn for our future Constitutional advice?

Nothing there about NOT giving unconditional dismissal. He merely stated he wouldn't give an unconditional dismissal based on his winning the Presidential battle. Roll Eyes

Oh, I see. So you've tuned down the dial from no crime to prosecutors having political motives.

34 criminal convictions - on top of the recent business fraud rulings, the sexual assault verdict and the arrests in three other federal jurisdictions on charges which, according to his own Attorney General, he's banged to rights on.

Come come, dear boy, it was so much cuter when you were sniggering over the fence. No crime!

Sentencing?

Why would he need to be sentenced?

Oh, that's right - he's a convicted criminal.

Found guilty on 34 felony charges.

But of course. That's because Panther didn't share the full article his friends were so keen to email.

Cunning, no?

Quote:
Since Trump’s victory in November, his lawyers have argued that anything short of dismissing the case would violate laws that protect the transition process and grant immunity from prosecution to sitting presidents.

In his decision, Merchan rejected those arguments. He called the Trump team’s claims a “novel theory” of presidential immunity that would amount to an abuse of his legal discretion.

“The Defendant has presented no valid argument to convince this Court otherwise,” he wrote. “Binding precedent does not provide that an individual, upon becoming President, can retroactively dismiss or vacate prior criminal acts nor does it grant blanket Presidential-elect immunity. This Court is therefore forbidden from recognizing either form of immunity.”

Merchan also dismissed a contention from Trump lawyers that the case was weak from the start, noting that Trump’s stature — as a presidential candidate in 2016 and as president in 2017 — made his behavior all the more egregious.

Finding otherwise would “cause immeasurable damage to the citizenry’s confidence in the Rule of Law,” the judge wrote. “It was the premeditated and continuous deception by the leader of the free world that is the gravamen of this offense.”

Trump’s lawyers tested Merchan’s patience in court, and the judge has criticized them for making what he described as baseless and repetitive arguments in their bid to get the conviction dismissed.

Still nothing there about NOT making an unconditional dismissal. Try finding that not related to his Presidency. There's a good chap. Wink

Now now, Greggery, don't be like that.

We've been through all this before. Lee's no Trump supporter, oh no.

The old boy never said anything about the rule of law.

Panther never wanted to get tough on crime or lock up corrupt politicians.

There's nothing to see here, dear. Just another day at the office, no?

Always absolutely never ever.

'Judge Juan Merchan, who presided over Trump’s trial in New York, denied the president-elect’s motion to dismiss the case due to his election victory in November.'

The words are Trump's claim, not the Judge's reasoning. The dismissal is denied, totally.

It appears that Panther is confusing the sentencing's “unconditional discharge” with the convictions being dismissed.

I'm sorry Panther, but the convictions remain - no charges are being dismissed.

Trump remains a convicted criminal, and will do for the rest of his life.
