NEW YORK — President-elect Donald Trump will be sentenced on 34 counts of falsifying business records ahead of his swearing-in Jan. 20, but is not expected to face jail time, a judge ruled Friday.

The decision to uphold Trump’s conviction and schedule the sentencing for Jan. 10 almost certainly means Trump will be the first felon to serve as a U.S. president.

New York Supreme Court Justice Juan Merchan wrote in his ruling that he does not intend to sentence Trump to jail. He said he plans to order an “unconditional discharge,” a designation in New York criminal courts for a non-jail and non-probation sentence that carries no other obligations.

The sentencing hearing is scheduled a day after Trump is set to attend memorial services in Washington for former president Jimmy Carter, who died Dec. 29 at age 100.
Merchan said Trump has the option of attending the hearing at the courthouse in downtown Manhattan or participating via an online video link

Now Karnal, please consider yourself informed of the facts......

Thanks for the correction, Panther. So your DL's case has not been unconditionally dismissed at all. His conviction on 34 felonies stands. He now faces sentencing on Jan 10, where we'll all get to hear his crimes, their seriousness, and the sentence he would have received if he didn't get elected as your POTUS.

You're right. This is indeed a great day. President Elect Donald John Trump does not get to evade justice in the state of New York. He will be forced to attend court and stand silent as his sentence is heard, recorded  and remembered. His face will be filmed for the duration of sentencing. The fake news will record his perp walk to his black SUV afterwards.

If your DL chooses to disobey New York law and not attend, a warrant will be issued for his arrest on Jan 28, 2028.

This is the law, exactly what you have been cherishing on our board for as long as you have been a member. If I recall, your position has been as follow

Then you changed your mind, as people do. Okay, you said, you might support someone being investigated, that's just allegations. But you would never support anyone with indictments before a court, or courts, of law. That was your red line. People can say all sorts of things, but indicted by the courts? Hell would have to have penguins swimming around and polar bears.

Next, you changed again, do you remember? Actually, you said, you might be inclined to support a politician with indictments, depending on the circumstances but never someone with a conviction, made by a jury of his/her peers. That would be unconscionable and beyond reproach. Not on your watch, you said, not in America. Hell would have to Eskimos living in igloos and fishing through the ice.

Now? You support a criminal convicted on 34 felonies, multiple civil rulings for bank, business, charity fraud, sexual assault, banned from doing business in New York and an additional three criminal indictments, one for preventing the peaceful transfer of power, facing the rest of his life in jail.

Thanks for informing us of the facts, Panther. Happy new year to you too.

Lucky you have Australia to come home to, no? I'd be leaving the joint too.

The judge gave President Trump the option.....Judge
Merchan said Trump has the option of attending the hearing at the courthouse in downtown Manhattan or participating via an online video link

You seemed to start off contrite, & rightfully so, but then it's obvious all hell broke loose within your make believe little world......all your cheese completely slid of yer cracker fella!!!!!

Oh my, you're right, Panther. I lied.

The big fella can do his hissy fit afterwards via a press conference at Mar a Lago.

There. Now that we've gotten that one off our chests, a question if I may.

What made you change your position on criminally convicted presidents?

Cheers.

So it was indeed you who brought up unconditional dismissal. And then you accuse panther of changing his mind. Unconditional discharge is indeed different.Maybe one day you will learn to tell the truth, not that I expect it.  Wink

You are such a tosser.

Oh, I see. You're after the judge's additional words, are you?

I'm afraid you'll have to read the article for that, Lee. I'd advise you to click on the link to Judge Merchan's ruling, it's all there.

And no it is not. The piece has been updated. Wink

I note AP uses the words "unconditional discharge".

Updated, was it?

Strange. I quoted the article here, dear. Which words were updated?

It appears that Panther is confusing the sentencing's “unconditional discharge” with the convictions being dismissed.

I'm sorry Panther, but the convictions remain - no charges are being dismissed.

Trump remains a convicted criminal, and will do for the rest of his life.

Yes....I agree with you Greggy.....but it seems Karnal is confused.....If you would glean back through this thread, it was Karnal that first brought up dismissals, & I responded in #17 accordingly.....to his reference to dismissals

You responded by saying that you assume judges have the authority to automatically dismiss a conviction by a jury of one's peers.

Just got this Washington Post Newsletter in my email this morning!

Great news to welcome me on my return from the USA.....GREAT NEWS!!!

Just 16 more days until the BIG DAY.......Monday, January 20, 2025.......can't come too soon!!!

..

Strange. Here's what the Guardian has to say on the matter.

Quote:
Judge Juan Merchan, who presided over Trump’s trial in New York, denied the president-elect’s motion to dismiss the case due to his election victory in November. He said Trump is expected to appear for sentencing either in-person or virtually.

https://www.theguardian.com/us-news/2025/jan/03/trump-hush-money-trial-sentencing

But I'm curious. I believe your previous take on doing crime involved doing time. What does your much beloved Constitution have to say about sentencing criminals for felonies?

Does it stipulate anything about unconditional dismissals?

Cheers.

Nope, & being the sentencing on the charges rests with New York State, one would conclude the ability to 'unconditionally dismiss' is their prerogative as well.

Happy New Year Wink

So I'm curious. What's your Constitutional position on having a jury conviction dismissed based solely on a defendant's election to office?

Judge Merchan has written an 18 page ruling on the matter. Do you contest it?

'Jury Exclusion of People with Felony Convictions by State.
New York. Excluded forever.'

Trump is unacceptable to answer honestly in a jury. He could get Musk to sit in for him or swear the oath on Jan 20, unless Trumps sweeps in with his gunmen on Jan6 game over.

I see. So help me to get this right, Panther. Are you now saying you never said you would abandon all support for your Dear Leader should he be indicted by a crime or crimes by a judge/judges to stand before a jury of his peers?

That's quite a claim. If you are now recanting this, what did you mean by hell freezing over first?

Perhaps, but Lee doesn't get News Ltd over in Western Australia, you see.

Not sure how he gets different versions of the Washington Post. Perhaps their internet has improved.

The sum total of what appears on my screen -

"President-elect Donald Trump will be sentenced on 34 counts of falsifying business records ahead of his swearing-in Jan. 20 but is not expected to face jail time, a judge ruled Friday.

The decision to uphold Trump’s conviction and schedule the sentencing for Jan. 10 almost certainly means Trump will be the first felon to serve as a U.S. president."

Yes that is correct. The bit at the end of the ruling also said that this finalisation leaves Trump in the position that he can appeal the convictions.

They think he will appeal the convictions but that could be a double edged sword as if he were to lose the appeal as he should that court could rule that this penalty is insufficient and give him a proper penalty.

An appeal could backfire spectacularly.

At the end of his second (and last}, term he could find himself going to prison at the age of 82.

I'm sure his lawyers are advising him to shut up and just accept the sentencing, and I'm sure some of those lawyers will be:

a) ignored

b) sacked

c) never paid
