Article 65 - SENTENCES OF PROBATION, CONDITIONAL DISCHARGE AND UNCONDITIONAL DISCHARGE
N.Y. Penal Law § 65.20
Current through 2024 NY Law Chapter 678
Section 65.20 - Sentence of unconditional discharge
1. Criteria. The court may impose a sentence of unconditional discharge in any case where it is authorized to impose a sentence of conditional discharge under section 65.05 if the court is of the opinion that no proper purpose would be served by imposing any condition upon the defendant's release.
When a sentence of unconditional discharge is imposed for a felony, the court shall set forth in the record the reasons for its action.

2. Sentence. When the court imposes a sentence of unconditional discharge, the defendant shall be released with respect to the conviction for which the sentence is imposed without imprisonment, fine or probation supervision. A sentence of unconditional discharge is for all purposes a final judgment of conviction.
N.Y. Penal Law § 65.20

It is a sneaky little Democrat game play of Lawfare, demonstrating once again that THE PROCESS IS THE PUNISHMENT. Unconditional discharge = No punishments will be imposed = lawfare.

Nothing about dismissing the charges though.

He will remain a convicted criminal for the rest of his life, despite the sentencing unconditional discharge.

Demonstrating once again that THE PROCESS WAS THE PUNISHMENT. Unconditional discharge = No punishments will be imposed = lawfare.

Despicable politicization of the legal system by the Dems, the people after your own black, creepy heart.

If he's ever remembered, it will be for being a convicted criminal (and a rapist, of course).

Don't break the law 34 times, and you won't be hauled in front of a jury.

It's that simple.

If it was true they would punish him.

But the process was the punishment. The charges were trumped up, the trial was a sham.

Same with the rape - if he was a rapist they should charge him. But they won't because its all made up political lies.
Ditto with the impeachments. Ditto with the charades with Biden as a mentally fully functional prez or Harris as a worthy contender. Colossal lies, cheating, deformed, spineless mendacity. Thed blowtorch should be applied to their collective bellies.

Oh, but it is true.

It's an indisputable fact.

So why don't they charge him with rape and punish him for fraud?

You know why, old boy.

Trump is a convicted felon and adjudicated rapist.

Those facts we know.

What we don't know is why you defend rapists and convicted felons.

Are you a rapist too, old boy?

In a New York Magazine article published in June 2019, Carroll claimed the event occurred "in the fall of 1995 or the spring of 1996" - more than twenty years prior.

She claimed she did not report the event to the police.

At the time, the criminal statute of limitations on such accusations was five years.

If New York's authorities were not aware of it, that explains why Trump wasn't charged at the time or within the five years before the allegation became time-barred.

In June 2006 New York changed the law but the change did not retroactively apply to alleged crimes committed before 2006.

Carroll could make a civil claim because of the Adult Survivor's Act which amended the civil statute of limitations to allow "alleged victims of sexual offenses such as sexual assault and unwanted sexual contact in the workplace to file civil suits between November 24, 2022, and November 24, 2023"

Bollocks.

Why didn't she report it within 5 years of it allegedly happening?
Why wait until he is prez and she has a book to flog?

Because he was prez and she had a book to flog, you silly old fool. Freeeeeedom, innit.

DL said she lied, she sued him for defamation and gave him the chance to prove her wrong.

You bet I will, he said. I'll testify and win, you'll see.

He failed at the first deposition. It went something like this:

I've never met the woman!

Yes, but how can you be sure? I'm sure a celebrity like you meets all sorts of people.

I'd know. She's not my type.

Oh? We're showing the defendant exhibit E, a photo of some B grade gala "event". The defendant is in the foreground, next to an unidentified woman. Now, would you care to explain who the person standing next to you in the photo is?

Er - hmm. I appear to have left my glasses at home.

Take your time.

Her? That's my wife - my lovely second wife Marla. A real hornbag, believe me.

Are you sure of that?

Yes.

Let the record show the defendant has identified E Jean Carroll.

Er...

No further questions. Interview terminated at 14,36.

He failed to testify, as you'd imagine.

WITCH HUNT !!!

How Donald Trump can make history and win 3 Nobel Peace Prizes

Trump can earn Nobel Prizes by fixing crises in Europe and Mideast,
as well as securing a nuclear treaty.

President-elect Donald Trump, with a policy of peace through strength and a Republican Senate behind him, will be the first United States president in decades who is positioned to resolve three major world crises, persuade the Senate to ratify major new treaties and garner three Nobel Peace Prizes, while saving the United States treasury over a trillion dollars.

Trump can do this by addressing the deepest and most dangerous cause of global instability – nuclear weapons. In 1990, in his first interview about running for president, Donald Trump articulated the challenge. "I’ve always thought about the issue of nuclear war; it’s a very important element in my thought process. It’s the ultimate, the ultimate catastrophe, the biggest problem this world has, and nobody’s focusing on the nuts and bolts of it. It’s a little like sickness. People don’t believe they’re going to get sick until they do. Nobody wants to talk about it. I believe the greatest of all stupidities is people’s believing it will never happen, because everybody knows how destructive it will be, so nobody uses [nuclear] weapons. What bulls**t."

Trump’s focus on nuclear "nuts and bolts" is exactly the path to major breakthroughs in world peace. Nuclear weapons are at the core of the world’s most dangerous conflicts. The scientific side of nuclear arms control is part of my own expertise; I and others have contributed to advances in technical methods for the United States, Russia and other nations to verify one another’s nuclear disarmament without revealing any information or having to trust one another.

Oh, I see. Is that why he's asked his lawyers to demand his conviction be dismissed?

Come come. Ask Panther to explain the difference between an unconditional discharge and a full dismissal.

You know, when he re-appears - poof! Like a genie

Yes, Master...

Yes, but it's very blurry, Greggery.

He hates wearing his glasses, you see. Whenever he trips over his pre-written rally adlibs, he blames the autocue company.
